Terms of Use for TrailTreks

These Terms of Use (the "Terms") apply when you use TrailTreks: NZ Topo Maps (the "App"), this website and the PLUS subscription. By using the App or this website you agree to these Terms. If you don't agree, please don't use the App or this website.

1. Who We Are

TrailTreks: NZ Topo Maps is an independent app built by a private developer in New Zealand. It is not affiliated with, endorsed by, or operated by Land Information New Zealand (LINZ), the Department of Conservation (DOC), MetService, or any New Zealand government agency.

2. Who Can Use the App

You must be 13 or older to create an account, or have a parent or guardian's permission. If you use the App on behalf of a child, you are responsible for how they use it.

3. PLUS Subscription

The App is free to use. PLUS is an optional paid subscription that unlocks extra features. The following applies to PLUS:

• Plans: PLUS is offered as a monthly plan and a yearly plan. The price of each plan is shown in the App Store or Google Play at the time of purchase, and is charged in the currency of your store account.
• Payment: payment is charged to your Apple ID or Google Play account when you confirm the purchase.
• Auto-renewal: PLUS renews automatically at the price shown unless cancelled at least 24 hours before the end of the current period. Your store account is charged for the renewal within the 24 hours before the current period ends.
• Managing and cancelling: manage or cancel PLUS in your App Store account settings or Google Play subscriptions. We can't cancel a subscription for you. Cancelling stops the next renewal; PLUS stays active until the end of the period you have already paid for.
• Refunds: all payments are processed by Apple or Google, so refunds are handled by them under their own policies (see Apple and Google Play). We don't have access to your payment details and can't issue refunds ourselves.
• Price changes: if the price of PLUS changes, you will be notified by the App Store or Google Play in line with their policies before the new price applies.
• What PLUS includes: PLUS currently includes unlimited DOC alert watches and weather alert regions, offline hillshade, offline experimental layers, the dark and high contrast vector maps, and snap to track. See the TrailTreks app page for the current list. We may add, change or remove PLUS features over time as the App develops.
• Your account: PLUS is tied to the TrailTreks account you are signed in to when you subscribe. To use PLUS on a new or reset device, sign in to the same account and use "Restore purchases" in the App.

For purchases made through the App Store, Apple's Standard Licensed Application End User License Agreement also applies, to the extent it is not inconsistent with these Terms.

4. Safety Disclaimer

Maps are tools, not guarantees. Always verify local conditions and trust trail signs over this app. Maps, DOC data, weather forecasts, alerts, trip plans and Location Beaconing are aids to your own planning and judgement, not a safety service:

• Location Beaconing is a manual check-in tool, not an SOS or live-tracking service. It can't contact emergency services and nothing is sent automatically. Don't rely on it in an emergency — use your phone's built-in satellite SOS or a distress beacon.
• Don't rely on alerts in the backcountry — they are a convenience, not a safety system. Alert checks need a connection, so treat notifications as best-effort.
• Trip plans and reminders don't replace telling a real person your plans. They don't contact anyone on their own.
• Booking status, safety alerts and weather warnings can change at short notice — always check the official DOC and MetService sources before you travel.
• AI track summaries can be wrong or out of date. Don't rely on them for safety decisions (see section 7).

Your use of the App is at your own risk, and your safety should always be your top priority.

5. Acceptable Use and Your Content

You may use the App for your own personal, non-commercial use. You agree not to misuse the App or its services, including by trying to disrupt them, access them in ways we haven't provided, scrape or bulk-download data, or use them for anything unlawful.

When you share a track, marker or beacon link, anyone who has the link can view what you shared, so only share it with people you trust. You are responsible for what you share and must not share anything unlawful, harmful or that infringes someone else's rights. We may remove shared content, or suspend access to the App's online features, if these Terms are breached.

You keep ownership of what you share. You give us permission to store, copy and show it to people who have the link, only so the sharing features work. That permission ends when you delete the item or your account.

6. Third-Party Data

The App displays data from third parties. It is provided as it is received, and we can't guarantee that it is accurate, complete or up to date. Always confirm important details with the official sources.

• Topographic maps and land data: sourced from Land Information New Zealand (LINZ) and used under the Creative Commons Attribution 4.0 International (CC BY 4.0) licence. © Crown copyright | Map data by LINZ.
• Huts, campsites, tracks and alerts: sourced from the New Zealand Department of Conservation (DOC).
• Weather forecasts: provided by the Norwegian Meteorological Institute (MET Norway) and used under the CC BY 4.0 licence.
• Severe weather warnings: sourced from MetService (Meteorological Service of New Zealand).

7. AI-Generated Content

Some track descriptions are written by AI (Google Gemini) and are labelled as such. They can be wrong or out of date. Don't rely on them for safety decisions. Check DOC and on-the-ground signs.

8. Online Features May Change

Online features (such as sharing, Location Beaconing, alerts and AI summaries) need an internet connection and our servers. They may be unavailable at times, and we may change or stop them.

9. Ending These Terms

You can stop using the App at any time and delete your account in the App or at /delete-account. Deleting your account doesn't cancel PLUS. Cancel it in your App Store or Google Play account (see section 3).

10. Your Rights and Our Liability

Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other law that can't be excluded, or any liability that can't lawfully be excluded.

Subject to that, the App is provided "as is", and to the extent the law allows, our total liability to you for any claim arising from your use of the App or reliance on its data is limited to the amount you paid us for PLUS in the 12 months before the claim arose. If you haven't paid for PLUS, we are not liable for loss arising from your reliance on the App or its data.

11. Privacy

How we handle your information is explained in our Privacy Policy. We handle personal information in line with the Privacy Act 2020.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the "Last Updated" date above. If you keep using the App after the Terms change, the updated Terms apply.

13. Governing Law

These Terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
